LET'S TALK MONEY: TERMS AND CONDITIONS FOR TRAINING SERVICES
1. The agreement
1.1 These terms apply to every quote accepted online or in writing. The quote, these terms and any annual plan schedule form the whole agreement.
1.2 The person accepting confirms that they are authorised to bind the client.
2. Fees, deposit and payment
2.1 Fees are as set out in the quote. If Let's Talk Money is not VAT registered, no VAT is charged.
2.2 Once-off training: the deposit shown on the quote is payable on acceptance. Training dates are confirmed only once the deposit is received. The balance is due 7 days before the first training date.
2.3 Unpaid invoices are overdue after their due date. Let's Talk Money may suspend scheduling for a client with overdue invoices.
3. Annual training plans (monthly fee)
3.1 The monthly fee is the agreed amount per employee multiplied by the number of employees on the plan. The client pays it by debit order through PayFast or by EFT by the due date on each monthly invoice. The number of employees is updated quarterly.
3.2 Debit order mandate: by choosing PayFast, the client authorises Let's Talk Money, through PayFast, to debit the agreed monthly amount from the nominated account on or about the same date each month until the plan ends.
3.3 If two monthly payments fail or are missed, the plan is suspended and no further training is scheduled until it is up to date.
3.4 The plan has a minimum term of 12 months, during which the rate per employee is fixed. After that it continues month to month and either party may cancel it with one calendar month's written notice. Training already delivered and not yet paid for remains payable.
4. Cancelling and rescheduling
4.1 Cancellation 14 days or more before a session: no charge.
4.2 Cancellation 7 to 13 days before: 50% of the session fee.
4.3 Cancellation less than 7 days before, or no-show: 100% of the session fee.
4.4 One free reschedule per session with at least 7 days' notice. Later reschedules are treated as a late cancellation.
4.5 Fees already paid for cancelled sessions, less any cancellation fee, are credited or refunded within 30 days.
4.6 If Let's Talk Money cancels, the client may choose a new date or a full refund for that session.
5. Learners and venue
5.1 The client provides a suitable venue (unless otherwise agreed), and is responsible for learners' attendance.
5.2 Learner numbers above the quoted number are charged at the quoted rate.
6. Materials and intellectual property
6.1 All training materials, workbooks, audio and tools remain the property of Let's Talk Money. Learners may use them for personal, non-commercial purposes. They may not be copied, recorded or resold.
7. Privacy (POPIA)
7.1 Let's Talk Money processes learners' personal information only to deliver, record and report on the training, and keeps it secure.
7.2 Individual assessment results and personal financial information are never shared with the employer. Reports to the client use combined, anonymised figures.
8. Liability
8.1 Training is educational and is not financial advice. Let's Talk Money is not liable for decisions learners make.
8.2 Liability for any claim is limited to the fees paid for the session concerned.
9. General
9.1 South African law applies. Disputes are first referred to the parties' senior representatives, then to mediation, before any court.
9.2 Changes to these terms apply only to quotes accepted after the change; the version accepted is recorded with each quote.
